These Terms & Conditions (“Terms”) govern the use of the Kiwibuyers platform by job listing service providers (“Providers”). By registering an account and posting job listings on Kiwibuyers, you agree to be bound by these Terms.

Agreement

These Terms form a legally binding agreement between Kiwibuyers and the Provider. Providers accept and agree to these Terms by creating an account and using the job listing services on the Platform.

Provider Eligibility

  • Providers must be legally registered entities or recruitersin New Zealand or authorized to operate in New Zealand.
  • Providers must comply with all applicable employment, recruitment, privacy, and anti-discrimination laws.

Only genuine job opportunities may be listed. No deceptive, misleading, or non-existent positions are permitted.

Job Listings

  • All job listings must be accurate, truthful, lawful, and non-discriminatory.
  • Prohibited listings include(but are not limited to):
    • Sexual services or sexually explicit roles.
    • Escort or adult entertainment jobs.
    • Jobs involving illegal activity or misleading terms.
  • Listings must include:
    • Job title and description
    • Qualifications or experience required
    • Work location and employment type
    • Application process and contact information
  • Providers must update or remove listings that are expired, filled, or inaccurate.

Provider Responsibilities

  • Providers are responsible for:
    • Managing the recruitment process, including communication with applicants.
    • Ensuring fair hiring practicesand compliance with employment law.
    • Maintaining a professional and ethical approach in all interactions.
  • Providers must not:
    • Charge job seekers fees to apply.
    • Post job ads that involve pyramid schemes, multi-level marketing, or unpaid trials (unless clearly stated and lawful).

Fees and Payments

  • Kiwibuyers may charge fees for listing, promoting, or sponsoring job posts as outlined in the Job Listing Fee Schedule.
  • Providers agree to pay all fees promptlyin accordance with invoicing terms.
  • Failure to pay may result in the suspension or removal of job listings or account access.

Applicant Data and Privacy

  • Providers must handle applicant information in accordance with the New Zealand Privacy Act 2020.
  • Applicant data must be used onlyfor the purposes of recruitment and not shared with third parties without consent.
  • Kiwibuyers may remove Providers that mishandle data or breach privacy obligations.

Kiwibuyers Disclaimer

  • Kiwibuyers acts as a platform onlyand does not verify, endorse, or guarantee any job listings or Providers.
  • Kiwibuyers does not guarantee:
    • The number or quality of applicants.
    • That a role will be filled.
    • The legal or contractual outcomes of hiring decisions.
  • Providers and applicants engage with each other at their own risk.
  • Providers agree to indemnifyKiwibuyers from any legal claims, damages, or liabilities arising from their use of the platform.
  • Kiwibuyers strictly prohibitsthe listing of any jobs involving:
    • Adult services, sexual content, or escort roles
    • Any Illegal, exploitative or misleading roles
  • Listings breaching Kiwibuyers rule (Term & Conditions) will be removed immediately, and the Provider may be permanently banned or reported to authorities.
  • Kiwibuyers does not verify every listing. Job seekers are responsible for performing their own due diligence.

Suspension and Termination

  • Kiwibuyers may suspend or remove Provider accounts or listings for:
    • Breach of these Terms
    • Posting inappropriate, unlawful, or misleading content
    • Complaints from applicants or authorities
  • Providers may terminate their use of the Platform with written notice. All outstanding fees remain payable.

Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be handled under the jurisdiction of New Zealand courts.

Job Seeker Responsibilities

10.1 Job seekers using the Kiwibuyers platform must:

  • Carefully review job listingsbefore submitting applications or sharing any personal information.
  • Confirm that the listing appears genuine, lawful, and alignedwith their expectations and rights under New Zealand employment law.
  • Avoid providing personal or financial detailsunless confident the listing is legitimate and relevant.
  • Report suspicious or inappropriate listingsto Kiwibuyers immediately via support@kiwibuyers.co.nz.
  • Understand that Kiwibuyers does not vet or guaranteethe legitimacy of each listing and that job seekers proceed at their own discretion and risk.

10.2 Job Seeker Notice – Acceptable Use Acknowledgment

Before submitting an application or sharing personal information on Kiwibuyers, please read the following:

  • By applying for a job or submitting your CV and personal information, you acknowledge and confirm that:
    • You have reviewed the job details carefully.
    • You understand that you should never send personal information(e.g. passport, IRD number, bank details) to unclear, suspicious, or unverified job listings.

Amendments

Kiwibuyers reserves the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new Terms.
