General

At Kiwibuyers Limited (“we”, “us”, or “the Platform”), you can purchase items by bidding, using the “Buy Now” price, or by making an offer where available. These terms explain your rights and responsibilities when using the “Make an Offer” feature or placing bids on our platform.

Using “Make an Offer”

  • Sellers can enable the “Make an Offer” feature on eligible auction listings, excluding restricted items such as firearms and alcohol.
  • Buyers may only make offers on listings where this feature is activated by the seller.
  • By enabling “Make an Offer,” sellers consent to receive notifications of offers and counter-offers made on their listings.

Receiving and Responding to Offers or Counter-Offers

  • When you receive an offer or counter-offer, you may:
    • Accept it;
    • Decline it; or
    • If you are a seller, make a counter-offer to the same buyer.
  • Offers expire automatically 24 hours after being made if no action is taken. Expired offers cannot be accepted later.

Making an Offer

  • Buyers may offer any amount less than the Buy Now price if the feature is enabled; if no Buy Now price exists, offers may be any amount.
  • Kiwibuyers may limit the number of offers a buyer can make.
  • You must only make genuine offers you are willing and able to pay for, as offers cannot be withdrawn once submitted.
  • Acceptance of your offer creates a binding contract to buy the item.

Making a Counter-Offer

  • Buyers may offer any amount less than the Buy Now price if the feature is enabled; if no Buy Now price exists, offers may be any amount.
  • Kiwibuyers may limit the number of offers a buyer can make.
  • You must only make genuine offers you are willing and able to pay for, as offers cannot be withdrawn once submitted.
  • Acceptance of your offer creates a binding contract to buy the item.

Accepting Offers or Counter-Offers

  • Accepting an offer or counter-offer forms a legally binding contract between buyer and seller.
  • Both parties must only accept offers or counter-offers they are genuinely willing to complete.

Declining Offers or Counter-Offers

  • Declining an offer or counter-offer means you cannot accept it later unless a new offer is made.

Bidding on Items

  • Bids must be genuine and made by parties who intend to complete the purchase if they win.
  • Fake bidding or artificially inflating prices is prohibited for both buyers and sellers. This includes shill bidding or collusion.
  • Kiwibuyers reserves the right to investigate suspicious bidding activity and may cancel bids or remove listings involved in such conduct.
  • Bidding constitutes a binding offer to buy the item at the winning price.

General Responsibilities

  • You agree to act honestly and in good faith when using the platform.
  • Any breach of these terms, including fraudulent offers, fake bids, or misrepresentation, may result in penalties including suspension or termination of your account.
